TransUnion Settlement

I have absolutely no idea when I decided to “opt in” the TransUnion Class Action Lawsuit, but a couple days ago I received my settlement.

Apparently, TransUnion was a bad credit monitoring agency and allegedly violated the Fair Credit Reporting Act.  Specifically, Plaintiffs claimed that TransUnion sold private information which it wasn’t allowed to sell.

This suit was a Class Action, which, according to Class Action World is,

A Class Action is a civil lawsuit brought on behalf of many people who have been harmed in a similar manner. A class action cannot be prosecuted unless at least one person harmed by the conduct is willing to serve as a class representative (Lead Plaintiff).

There is a much better definition on Wikipedia, but it is technical and starts quoting Federal Procedure Code, so we will go with the one above.

As part of the Settlement I was given the following options:

  • File an individual lawsuit against Defendant(s) for claims related to target marketing and prescreening: You can also signup for six months of credit monitoring.
  • Sign up for six months of credit monitoring services: You can also register to receive a possible cash payment in the event of a cash distribution or file an individual lawsuit against the Defendants.
  • Sign up for nine months of enhanced credit monitoring services: You will not receive any further benefits, including a cash payment, and you will not be able to file an individual lawsuit against the Defendants.
  • Register to receive a possible cash payment: You can also sign up for six months of credit monitoring; however if you receive a cash payment, you cannot file an individual lawsuit against the Defendants.
  • Do Nothing: You won’t get any benefits. You will keep your right to sue the Defendants individually (see the detailed notice and Settlement Agreement for more information).

I will be completely honest – I have no Idea which one I chose, but considering I received the below e-mail and I like to think I know myself, I chose some sort of monitoring option.

The ability to lock your credit report so third parties, such as lenders or other companies, will not be able to access your credit report without your consent (unless allowed by law);

Unlimited daily access to your Trans Union credit report and credit score;

Credit monitoring with email notification of critical changes to your credit report;

A suite of insurance scores; and

A mortgage simulator service.

Ready to get started?

Your registration number is <XXXXXXXXX>. Be sure to enroll soon as your registration number is only available for a limited time.

Just click here and enter your registration number and you’ll be on your way to credit monitoring!

Well it was relatively simple to register for the class action settlement, and boom I had access to my credit score from TransUnion.

I was happily surprised when I finally got my credit score.   While I routinely check out Credit Karma, and review my Free Annual Credit Reports, I never take advantage of the up sell on the score itself since it doesn’t matter right now (not moving anytime soon, have no CC debt and not buying a car).

Did you participate in the Class Action Suit? Have you received your settlement?

  1. How did you know that the email was legit? I rec’d a similar email with similar but not identical language and was hesitant to give my social security #.

    When I received it I was worried, so first thing I did was google it, and found out that the settlement was in fact true.

    Then I searched my old email and found that I had in fact signed up for it 18 months ago.

    Then I looked up the domain and found it was in fact a TransUnion domain.

  3. Thanks for this. I got the same e-mail and suspected that it might not be legit. So I’ve Googled around and found this blog. Of course, even this blog could be part of the conspiracy to get me to give up my SS number! Just kidding.

      If it is a scam lol then I have been scammed – but a google search (where you found me) also has links from kiplingers, cnn, etc.

  4. This is legit. I just called transunion and customer service confirmed that the email is from the settlement.

  5. I too received the email 1/4/10 but I receive an error that my registration code isn’t valid. Anyone having a similar issue?

      I had a problem signing in afterwards because it is from a different website (NOT just the truecredit website). Could that be the problem?

  6. Oddly, everything now works and I’ve since logged in and gotten my information. It may have been my employer network causing something to misfire, or maybe the TU site was having issues at the time. But looks like I’m good to go now, thanks.

  7. I too recieved the email this week and when I try to log in, it stated the registration number was incorrect. I guess i will wait and try again, maybe it is there website updating.

  8. Can’t believe the variability between scores! Middle-aged married male, mortgage paid for, and only expenses are revolving credit on two cards (no where remotely close to 30% of limit and no balance carry over each month) and one car note for daughter (current). Score is 50 pts. less than Experian from just 2 weeks ago (>800 then). Says I have too much available credit (remember, you’re told not to close out old accounts) and I need more credit cards (I use two, MC and Amex). I see that they still have my parents address listed as a prior address (never lived there). I don’t have a lot of respect for this company but unfortunately they do count as one of the big three.

  10. Trans Union is not honoring most claims. They refuse to verify your identity if the only information on your report is credit card information. They want you to fax them additional information including a copy of your photo driver license. What kid of and idiot would do that? How do they verify the photo ID over the internet? They start the clock running when you attempt to apply based on the email they sent you but refuse you access saying they can’t verify your identity. I asked them to mail me at my home of record or to get my phone number from information and call me back. They refused. They are not acting in good faith.

  11. I was apart of this also but lost the email that was sent to me. I just signed in using the link ED provided and my claim registration number and I’m in. This came at the perfect time since I just went through a bankruptcy and was interested in how it affected my score.

  12. My husband and I registered for the Transunion Class Action suit. We both received emails (he is in Iraq) but he apparently accidentally deleted it, does anyone know what he can do?

  13. The registration e-mail states a suite of insurance scores as part of the settlement benefits. Yet TransUnion wants $9.95 for these items.

    Anybody else, same thing?

    • You aren’t reading it correctly. TransUnion just settled so their stuff is free – everyone else’s you still have to pay for

  14. Am I the only one whose Registration doesn’t match and get the following message: The registration number you entered does not match the one previously assigned to you. Please re-enter.
    Anyone know how to fix this? A telephone call to TrueCredit resulted in the telephone shuffle and of course Trans Union doesn’t provide a telephone number under Customer Service. Thinking Cookies might be the problem I deleted them in IE and Firefox but that didn’t help. I’m looking for suggestions.

  15. I receive monthly an email from: “settlement transunion com”. Subject: monthly update for NED: Your credit alert & ID protection program.
    There is never a message or any other information included or attached. Reply always brings the message “this email box is not equipped to handle customer inquiries” I find no phone number on the TRANSUNION web site to address this. Suggestions ?

    Also on the bandwagon for this, the initial opting in was over a 1yr ago I think.

    Class Action Suits are awesome. Like free gambling! The other one was the foreign transaction fee on credit cards. If you hear of anything new and exciting – pass it along!

    • Completely Agree! Love the random letter from Class Action Suits. The Wife got one years ago – check from tmobile.

      Did you take advantage of the settlement? How did your credit report look? Everything you expected?

      • I did. Yeah it was fine. Although I wish I would have saved it for later. The trial period starts as soon as you accept. Since I haven’t much credit action recently…there’s nothing new to report.

        Side function – they allow you to freeze 3rd party inquiries.

  17. I’m glad it wasn’t a scam and you were able to get your score…..these days you have to be really careful about responding to such emails. Checking the domain is a great way to avoid spam.

  18. Excuse me but one’s credit score really does matter, even if you don’t need a car loan.. My homeowner’s insurance just spiked 26% due to a credit score. Wait for it…..auto insurance is next!

  19. Funny how people talk about getting their settlement chcks, but fail to post the amount of them. I will pass on a $3 check. Not worth the time or effort, and these attornys will take at least $70 mil of the $75 mil settlement.

    • I signed up for this also but I don’t ever remeber getting an email or a check! $3! That is a joke and a waste of time. I seriously hope you were just kidding! Did anyone else get any so called “settlement”? If so, please share the amount…just wondering if it’s worth a stamp writing to them to ask about it.

      • One of the two checks came for $209.00 (My dad’s check) I am waiting or mine since I filed for both at the same time The check came monday Oct. 1st 2012. We were part of group two.

  20. I fail to see a fair value of restitution from Trans Union. Providing free credit monitoring is capitalizing on a service that should be provided for free, to protect your information from the possibilities of their wrongful actions. This private LLC, physically has possession of the most important financial asset you will ever own. And for a short time they are offering you the permission to protect it, followed by a fee for life to protect a possession that is your write to own. And then, your life history (possession) is sold and you have no rights to any royalties.

  21. Here is what I don’t understand. There is a group of lawyers that are advertising on TV where I live saying that you can still make a claim against the judgement. The reason I find that strange is because all the websites and court documents I see say that the lawsuit closed to new participants in 2008. How can lawyers take on new clients for this suit? Does anyone know how that works?

    The site for the lawyers is tuclaim.com and that is saying that the deadline is 9-17-10. The site does mention post settlement claims but the whole thing sound fishy to me.

  22. The fact that you received an email is one of 2 things: 1. Amade up story so people click on your affilliate link. or 2. You really don’t know better and you thought that email spam was legit.

    The lawsuit is done through regular old snail mail via attorney which requires your real signiture and is not done through email.

  23. You have been Receiving your settlement for 10 months? Well that is different from the 6-9 months you wrote in the article.

    The point of my comment was obviously to inform people not fall for any email scam or spam. If someone did already or does sign up for the credit monitoring under the terms in your article, they forfeit the right to get any money they could be entittled to.

    If someone wants to be a part of the settlement they would be much better served if they would seek an actual attorney.

    As far as links…. There are google ads and afilliate links all over this webiste. I know its normal, but no reason to deny it.

    • You are right about the date. Sorry about that.

      This post was about my choices….I think I highlighted those choices pretty well (possible cash/right to sue/the service). Scam and Spam is different than making a choice you may differ with.

      As far as working an attorney, I am all for it! I don’t think I stated otherwise, like I said, this post was just about my experience with it.

      Adsense and affiliate links are two very different things.

  24. I just viewed the videos from this law firm out of San Antonio, TX about the transunion settlement for $75,000,000 – they want to represent you. They send you to this website called tuclaim.com? What’s up is this legit. There deadline is for September 17, 2010. I also seen there commerical on television.

  25. Is this for real or not. Was told to check it out. My credit was totally destroyed and I have not had any for many years because of false information on my credit reports. My identity without doubt has been hijacked. Is it still possible to make any sort of claim?

  26. I signed up for the cash settlement but have not heard anything about when its supposed to really be distributed. The website still has the old information and the toll free number to call does not have any new information either. Have we been forgotten, has anyone received a check as of yet?     I also recd the E mail from the attorney. I did a little research and found that the “Individual Lawsuit” was filed in Nueces County TX in small claims court. You can Google it and go to the clerk’s site and put in your case number the search bar and it will show your case on file. Incidentally small claims is capped at $10,000 in Texas. Hopes this helps you.

  30. Its legit. I went to the Nueces County Clerks web site and used their search engine and found my case on file. As far as what the attorney’s will take from any settlement I haven’t a clue. I look at it this way a dollar more than I had before so it can’t hurt. I will say don’t get your hopes up too much. I had another “Class Action” suit with Expedia over a cruise my wife and I took in 2005. I recd a check in June 2010 for 2 cents…LOL needless to say didn’t cash it only framed it!

As I recall from the attorney advertisement, you could receive between 100 and 1000 dollars per occurence; since I had a mortgage, a couple of car loans and credit cards during that time period I figure it might actually be more than 2 cents LOL.

  33. Well I had refinanced my mortgage three times had two equity loans and over the years in question 35 assorted credit cards.Two car loans and so many credit card offers in those years i could fill the back of my pickup.So what does that mean i will get a cash settlement of a dollar.

  35. Last time i Heard anything was November. I heard we were suppose to get 100 to 1000 per incident and the lawyers charge 40% so far nothing .Might get my bucks next year after the Lawyers drag it out for a year.

  37. He didn’t really say because they are still haggling with Trans Union; if you didn’t get an email you really need to contact the law firm because it was supposed to go out to everyone that the firm is representing in this matter.

  38. Finally got a reply ,if you did not get a rejection letter you still in the lawsuit.But Transunion is putting up a fight and the lawyers have to prove the transgression by transunion.Then they will settle for the amount soon in spring they said .But its summer now….

    • I received a notice that said “2nd notificiation” (not sure where the first one went??), and they said that TU settled for cash and that only the first 13250 would get the same amount of cash, $43.00. HOWEVER…the attorney will be getting $243.00 of it, so as usual, even though they do little, suffer nothing, they get the bulk. It is the only reason that class actions are filed. the attorneys know the individually people can’t afford to do what can be done, so they bump u all the charges, take the big bucks, and give the peons something to appease them. They laugh all the way to the bank. Attorneys have created a complex legal system to support themselves, not to improve justice or do what is right. We need to steamline the justice system so that we can pursue justice and keep the money ourselves. I am sick & tired of the ‘attorney middlemen” who are millionaires and billionaires while we receive chicken scratch for our suffering. (this case was not “suffering” per say, just a point for other cases of cars failures with wrongful death, etc).

        $443.00 per person, not $43.00. either way, I don’t see any thousands going out as noted before by someone. If they are getting $75 million, and are only giving 13,250 people $443.00 each, minus their fees, which states in my agreement won’t be more than $243.00 (yup…they get most even of that), then that leaves $69, 130,250.00 for the attorneys, and THAT IS BEFORE they take their share of each $443.00…??? Something is very wrong here! there is no end to the greed of corporate attorneys. If there are three principals in the company, that’s about $23 million apiece. Not bad for a days work that mostly junior members did!!!

  39. By the way there are only 104 thousand people total from all law firms that are being represented by lawyers against trans union,To get a total of 75 million dollars thats about a few thousands of dollars each

  40. my understanding is that the vast majority of that 104,000 did not receive a monetary award so….those of us that jumped onboard at the very end can probably expect (just a guess, I’m nobody) around a couple of hundred up to a thousand depending on how many times Transunion gave out your info.

    • All the people who signed up before 9/24/08 are waiting a long time and should receive there benefit before those who signed up at the end. I am sure there will be many complaints if that does not happen.

  42. I have been waiting to here from this lawsuit now since forever. I check my mail and e-mail every single day since the day I sign up, and no respond.

    • I also was offered and accepted the monetary settlement option of 443.00 of which I would get 200.00(there was no credit monitoring in my options. Just accept or not). I got my documents stating that my e-sig was accepted, here is your signed agreement and that, was that… This was months ago and nary a word since. No emails, no checks (I verified my mailing address, blah, blah, blah. Sent the attorney several emails weeks ago. No response. Finally called the office last week. Well, I was NOT one of the 13,250 even though I responded the same day I got it. I am in ‘group 2’ now and probably won’t see anything. The long and short of it is that a week AFTER I called the attorney and read him the riot act for not communicating my status and after getting my group 2 status verbally, they FINALLY answered my email inquiries yesterday. Big whoop! Here’s the text of the email: I still don’t know why I was relegated to ‘group 2’…”Thank you for your email. We received your acceptance of TransUnion’s offer. Unfortunately, you were not among the first group of 13,250 from whom TransUnion accepted paperwork. However, TransUnion assigned you to Group 2 of the settlement. This was out of our hands; therefore, we cannot speak as to why you were not in Group 1 of the settlement. As soon as TransUnion receives court approval to fund Group 2, the process for distributing of such monies will begin. We are expecting the court to rule by September 2011. We do not have any information at this time as to the exact amounts of the payments or time limits on when things will be settled; however, we will notify you as soon as we obtain more information.There is no further action required of you at this time. Should you have any further questions, please do not hesitate to contact us at 1-xxx-xxx-xxxx [I took out the phone number].Thank you for your patience with this matter.Sincerely,”So here I sit not knowing what group 2 is or why I was bumped there or why. Am I going to be bumped to ‘group 3′ the next go ’round and so on and so on?

  43. I just reviewed and accepted the offer, it is $443 minus the law firm fees but guaranteed at least $200 according to the document.

    I signed up back in 2008 and chose to received a free six month subscription to TransUnion and to received any cash settlement. But I have not heard anything about getting any money yet. If this is the same lawsuit, was the offer sent in the mail? Any help is appreciated.

    • After reading more of the previous posts and doing some googling I believe that those here who recieved an offer was for individual lawsuits and not for the class action lawsuit that I joined. Am I correct?

  50. Got a call today from a lawyer saying he was representing me in a class action suit against Trans union. I am going to reject trans union’s offer and sue them just to tie them up in court. This corporation knew better but violated the law because of greed.

    • Well that makes a lot of sense – you’ll spend more in legal fees in 2 hours then you’ll ever possibly get back from the company.

      • It is not about the money it will cost trans union more than me. Trans union has already amited their guilt by offering a settlement. I just want to these leaches of society to pay. I also intend to ask for attorneys fees.

    • Did you notice the part where it states:

      “If you do not promptly accept or reject Trans Union’s cash offer to you, we may withdraw from your representation, and if we withdraw, you will be compelled to find substitute counsel or represent yourself in your Lawsuit, as defined below”?

      Unless you have SOLID PROOF that you were PERSONALLY affected, in a NEGATIVE manner, by a SPECIFIC action on TU’s part, rejecting the settlement will almost certainly result in being dropped by the law firm and you would be hard pressed to find another firm to take the case on contingency, making your rejection would be done in vain and TU will end up getting off free and clear in your particular case.

      I think they should face serious repercussions for what they did too, but I have absolutely no documented proof that I was personally and negatively affect by the actions of TU between 1987-2001. Considering there are very few people that would be able to provide that kind of documentation, $443 is the BEST offer most people will receive. It certainly beats the “free credit monitoring” they initially offered (that many people actually accepted).

      I’m much more bothered by the fact that the lawyers will be keeping $243 of each accepted settlement. That’s almost 55% (on top of the money TU will be paying DIRECTLY to the attorneys). This is the reason I hate class actions suits. In 95% of the cases, the individuals actually affected usually receive a nominal pittance, which is rarely in the form of actual money, while the lawyer receive millions.

      I would suggest everyone that has ever been a member of a multimillion dollar class action suit and received settlements like coupons or “free” services and/or merchandise band together against the class action attorneys that are keeping the cash part of the settlements for themselves, but I imagine it may be quite difficult to find a qualified class action attorney to take a case against class action attorneys.

  52. I received the offer letter a couple of weeks ago and was offered the 443. I was wondering if some of the people were going to hold out to see if they could get a larger chunk of the pie? Not everyone will respond to the emailings, and how much more of the pie could one get? And how long again would it take to hear from the Lawyers? I signed up last year and it has been about 9 months ago til I received this offer.

  53. I received my letter on yesterday June 22 2011 and I accepted the $443.00 while reading over the documents I saw nothing that said I would only get $200.00 out of the deal. And from previous lawsuits the lawyers usually take their chunk of money off top and whatever is left over gets split up among the rest of the claimants. But whatever the case free money is free money any day

    • Actually it says that you will pay 35 dollars for court fees, 25 dollars for the electronic signature, and 45% in attorney fees. But it also says that it can’t be lower than 223 I believe.

This is something that I know a little about if 10or20 or more poeple lock it up with T/U in court the payout could be a lot more if said poeple’s fined a law firm to have ago on a % fee the lawyer’s will take 33/3% that leave’s 66.2/3s% to the ones that hang with it,also bare in mind that they are going to settle out and that my fellow american’s is a guilty plea,also the letters that were sent by those lawyers only tell us what they want you to beleive that its for the best,it is FOR THE LAWYERS who only want to help us help them to are just due’s laws were blatantly broken and trans union is well awear of this so there is why they are making the 75.000.000 offer to make it right,The letter states that you may have to pay court costs and att fees so its best to take the deal because trans union will drag it out 1,2 or 20 years so the lawyers advise take the money its in your best intrest.they use our names for monetary gain&greed with no thought of what we would be put throught at the very least transunion and there affiliates are without adoubt laible for defimation of character of the masses if not then i ask you why then do they make the offer!United We Stand dividide we short sell ourselves,

However this week I got another email from this law firm that’s representing us in this lawsuit stating that they are going to get roughly half of the $443.00 we are supposed to get; leaving us roughly $200.00. Now just like another poster said in any class action lawsuit the lawyers already get their fee off the top. Any law firm worth their salt is going to make damn sure that some kind of provision concerning their fee is included in any settlement proceeding. Just like another poster stated I didn’t find out about this until after I esigned the acceptance letter. I mean free money is free money but I don’t think these lawyers should be getting paid twice.

  60. I was contacted relative to settlement and promised 443.00. I accepted within 24 hours. Got a second email over a month and a half later advising me to accept as it was “first come, first served”. It seemed as if the attorneys did not acknowledge my first acceptance to the their first email. I was told I was not in the first group of claimants after all but assured me I would probably be paid. Really, never heard of a class action being handled in this manner. I am filing a complaint with the State Bar Association against this group. They appear to be a disreputable firm. Surprise.

  61. I received an e-mail on August 5, 2011 stating that I was part of the Group 1 Settlement, and to expect my check 2-7 days.

I received a phone call the day before yesterday telling me that I’d been selected by TransUnion as one of the recipients of the first phase of payouts, and that my settlement package, including my settlement check, was mailed to the address on record and should be received within the week. We’ll see! Like many have said, money is money, and I’m not at all upset with the amount they’re keeping. I would have never known about this money otherwise.

I also gave them the information for this site so they can correct any other erroneous information that was there.

    I accepted the settlement and even though I accepted within 30 minutes of getting the email I just got an email stating that I somehow was not in the first 13250 or so, so I am in Group 2.

    This means I have to wait for court approval to get money (which means I may see nothing…the settlement agreement only seems to cover the first 13250.)

    I also get no option to sue now since I accepted it. I feel ripped off on this deal.

I esigned all the letters got on the website ontime and received a letter on august 5 saying a check had been mailed out to me well i live in north carolina i havent seen no check yet and it does not take 20 days for mail to come to north carolina from texas it only take 5 to 7 business days, i called the lawyers office and they reassured me that the check was on the way, well i didnt see anything in the second week, i called them again and they told me to give it 3 more days well i gave it three days and i still havent seen no check so some how right now i think all this transunion lawsuit and the feel so much like i been in a scam right now and i called the lawyers office and told then i feel like they scammed me out of my 443.00 they promised me that amount now why are they taking and handing me 200 to me they cashed out original check and put in in the bank to pay ther others on the lawsuit. As i recalled sigining the document they stated you will be getting 443.00. but any is better than none right now but to be told the check is in the mail and check the box and see nothing everyday for 20 days sounds like a bunch of bullcrap to me.

    • I have the same problem EXCEPT that payment has not been sent. the $443.00 is before the lawyers 40% fees. I also live in NC and when I emailed the law office, I was told that I was in the 2nd group and have to wait for appeals, even though the day I received my letter, email, and phone call about accepting the offer, I accepted the offer in JUNE and still haven’t received anything so please feel lucky that you got $200.00

  78. Like Kay, I hadn’t heard anything so I decided to give the law firm a call and was told I was dumped in group 2 due to TU’s criteria. Additionally I was told the firm did not know what the criteria was and I would have to wait until the courts settled sometime in September. So for those who have not heard anything assume your in group 2.

  79. I was told you get in group 2 by no filing in time. It would appear that it was first come, first serve and the first 13K or so got group 1. The rest got screwed, I mean, group 2.

    The last word from the law firm (Watts, Guerra Craft) was that for group 2 people, they have to go back to court for a hearing on paying (if at all) those people. This court date won’t be until sometime this month.

    • Ann, I actually accepted the offer minutes after receiving the email. I’m sure it is possible that some people accepted the offer within seconds but I personally believe the law firm is giving different information to everyone to quickly get them out of their hair. I was personally told by someone handling the lawsuit;, that certain criteria placed me in group two and the criteria was set fourth from Trans Union. No where in the conversation did she mention anything about not filing in time. At this point I am expecting nothing.

  80. Monique, like you, I filed when I got the email so there was no issue of not getting it in time. It was not filing in time, it was more the order processed on the other side…only the first 13250 got a check with no questions asked.

    I think everyone is getting fed BS to go away; even their own paperwork says that if you got the second letter (settlement) you met the criteria set forth by TU. If you did not get a settlement letter at all, you didn’t.

    If I had known I would have been stuck in the “no money” group I would have rejected the offer so I can pursue things with a private attorney. I am about to sue them for something else entirely anyways and will likely see way more than 209 bucks but this robbed me of my right to do that. Grrr.

  83. The same story here. Was promised 443.00. Replied within the same day as the email notice. Was not told anything until I complained. A Mr. Thompson told me I was now in Group 2 and he was working hard to get Group 2 paid. That was mos. ago. Never told what criteria was and filed on time.

    Will now file a Complaint with the Federal Court where this Settlement for the plaintiffs (big winner Watts Guerra Craft) was reached and file a complaint against Mr. Thompson with the State Bar Association for misleading and deceptive practices and statements.

  84. I’m surprised at the number of people bitching about money that you wouldn’t have had in the first place, and that you haven’t had to really DO anything to get “in line”. Everyone was “promised” $443, but that is BEFORE the fees; everyone that is selected will get the same amount. I also believe there was more to getting into Group 1 than just replying to the e-mail. I received a notice saying that I’d been “selected” as part of the Group 1 participants, indicating that there was more criteria than just e-signing that response. I’m glad I was selected, but again, it’s money I wasn’t counting on or budgeting in, so I didn’t stress as to getting it or not. I guess I was just lucky. Good luck to everyone, but it seems that spending time filing complants with the Federal Courts on something you don’t really have any control over is a waste of time and energy.

  86. I talked to someone at the law office on Friday, they told me I was in group 2. I asked what the criteria was and they said it was a lottery conducted by TU, they had no say in what group a person was placed into.

    She did say that they head back to court for group 2 disbursement later in September, so we should be hearing something by mid-October.

    And it would not have been “money I did not know about” as I am suing them for other FCRA violations without a class action attached. If I had attached this to the other suit I may have had this money and then some…and not had to split it in half with the firm.

  88. Got a new letter today. TU filed an appeal on the 22nd. If it is not denied in the next 30 days it could be a year before things are resolved. Next news update will be no later than December.

    And now the letter says “you were not among the 1st 13,250 of our clients selected by Trans Union (that is, our Group 1 folks), whom Trans Union paid without the Judge’s approval. Under the terms of the settlement, Trans Union had sole discretion to select our Group 1 folks, and Trans Union merely provided us a list of their selections; we were prohibited from participating in the selections.”

    Had I known that they were going to pick the 13K people, I would have rejected it. The original mail I got indicated that you had to hurry because the first 13250 were going to get into group 1.

    If you are in group 2, don’t bother anticipating a thing. We are not going to see a dime.

    My beef is “hurry and accept, it is first come, first serve otherwise you have to wait” is WAY different than “Defendant will pick and choose who gets paid first and we are not privy to how and why, and the rest of you may not get squat.”

    Of course if I don’t get paid, they don’t either. But they already made millions off Group 1.

I had am e-mail address to contact them and sent correspondence with them and was told that someone would contact me within 24 hours on numerous occasions but of course no one ever did. I complained asking if the attorneys had to wait 3 years to receive their millions in compensation as we do. I guess they did not like that and everytime we get jerked around asking to wait another year to be compensated. This is so frustrating and I dont think we are going to receive anything while the attorneys monitor the account and skim off of the top for monitoring fees.

I was just told many checks were sent back because the clients did not provide correct info. Well I know in my case that is untrue since I have lived in the same home for the past decade.     The Federal District Court in Illinois granted TransUnion’s request to receive monies from the settlement fund to pay the remaining claims to all of our qualified clients and approved our settlement.
    September 14, 2011 – Class Counsel Files an Appeal
    On or about September 14, 2011 class counsel filed an appeal of the Court’s September 8, 2011 Order to the United States Court of Appeals for the Seventh Circuit in Chicago, Illinois. Class counsel has been opposed to our settlement with TransUnion from the time we filed your claim. At various times, they argued that our settlement should not be reimbursed from the settlement fund. The court categorically rejected that argument. Class counsel also opposed our settlement arguing that they should recover additional attorney fees from the settlement fund in excess of the $18.5 million they have already received. The court also rejected that argument.
    September 30, 2011 – We Are Pushing to Have the Appeal Denied Quickly
    At this time, we are trying to get the appeals expedited to speed the time for a ruling from the Court of Appeals. While we can never give a guarantee of victory, we are confident that the law is on our side and the Court of Appeals will uphold the District Court’s rulings in our favor. We are doing everything to speed up the appeals process. However, until then the court will not release the settlement funds to pay the remaining claims.
    October 20, 2001 – A Briefing Schedule Has Been Set
    An expedited briefing schedule has been set for the Appeals case. Appellant’s brief is due November 2, 2011; Appellees brief is due December 2, 2011; and Appellant’s reply brief is due December 16, 2011. After the briefs are submitted, a date will be set to present oral arguments to the court.

They need to let people know what is going on through the email or mail. This is not right for the class members.   107. I also received that email notice sometime last year. I was afraid of what everyone is complaining about happening, so I rejected the settlement. Shortly after, I received a new email requesting my reasons for rejecting the claim.

    I listed several reasons, but one was because I think these class action suits need several people to gain momentum and start up, but then they want to weed out as many people as they can so they don’t have as many people to split a settlement with. The offer of $443 is tremendous, considering most settlements I’ve ever seen or received (which, by the way did not require any answering emails or providing so much information to them) have only been about $2-3 and some change. However, if I remained in the class without the settlement, I stand to possibly get much more. Of course, I also risk getting nothing.

    I was concerned that even if I did respond immediately, out of the possible millions of clients represented, I may not be one of the Group 1 people, and I did not want to end up in Group 2 and get nothing but a thank you for being on our list to get this suit started.

    Those of you who received $200 or so should feel lucky you got anything at all, but you were screwed because as I remember reading the email, it was supposed to be a $443 minus their cost to file on your behalf (about $31). So you should have received $412.

    Anyway, after submitting my reasons for my rejection, I have heard nothing at all. I expect the lawyers and about the initial six or so people who started the suit will split millions. Most of us were just names on a list to allow the action to happen and will not see a penny. As I said, if you’ve received a couple of hundred bucks, you should feel d— lucky about it.

  108. Found something very interesting concerning the “hold up” for those in group 2. When they said they were waiting on court approval, they weren’t exactly lying, but they weren’t telling the whole truth. As it turns out, the defense, the ones supposedly representing OUR best interests, are the ones causing the delay. They want more money for themselves. On top of the millions in legal fees they have already been awarded AND the 45% of they are taking from participants, they are requesting millions more to be awarded directly to them.   109. On 12/28/11 I rcvd an e-update from Ryan Thompson. I’m not permitted to reprint the letter, so here’s the gist of its message in my own words:

    Update re Group 2 of the TU Litigation
    1. On 9/8/11, the judge approved the Grp 2 settlements for payment

    2. Then on 9/22/11, a grp of lawyers filed an appeal in connection with the judge’s order and, as a result, thus causing an appeal to the Seventh Circuit Court of Appeals defending the judge’s order

    3. To date [12/28/11]the Seventh Circuit had not issued a briefing schedule in connection with the appeal, so case is on hold, awaiting a briefing schedule

    4. When the Seventh Circuit issues a briefing schedule, we could have a decision in 9 to 18 months

    5. The wide time frame depends on which judges hear the appeal and the time required for them to issue an opinion

    6. The firm will vigorously defend the Judge’s order approving the Grp 2 settlements for payment. They say they will not get paid until we get paid, so “we’re all in this together”

    7. The federal courts can be slow to grind out justice, and the firm is powerless to push them; of course, the firm appreciates our patience, they’ve spent thousands of hours and millions of dollars on the case, so they’re committed to victory

    8. They will provide you another update in the spring, as the appeal gets underway

    • The group of attorneys that filed the appeals are the lawyers that are supposed to be representing US. The problem I have with their appeal is that it in no way, whatsoever, helps any of the class members. They are asking the judge to give THEM more money for legal fees on top of the $75 million AND the 45% they are taking from us. We’re not getting our money now because our attorneys are being greedy.

    March 8, 2012 – Court Adjusts Briefing Schedule
    The Court granted another party permission to file a brief, and therefore adjusted the briefing schedule. Brief of Party-in-Interest Dawn A. Wheelahan is due by 03/23/2012, and any reply briefs are due April 16, 2012. Dawn Wheelahan is same attorney who the lower court blasted for attempting to milk every nickle she could from the original class. See the order here, it is worth the read.

    All briefs in the appeal were filed April 16, 2012. The 7th Circuit Court of Appeals will now make a decision, and hopefully soon. The Court may require oral arguments before it makes its decision

    Trans Union Update! The Seventh Circuit Court of Appeals ruled in our favor! Having made it over this hurdle, we hope to provide an update very soon regarding progress and time-lines of distributing payment of the settlement to the many thousand people who trusted us to represent them.

  117. Chris and others,, I appreciate your info and updates.. my life is literally hell, I am suffering from a fatal disease and any monies helps my life greatly, I haven’t been able to work for 20 years..
    and Veterans Affairs denies everyone’s claims and makes them appeal which takes years and years.. so any money is very helpful when you are totally disabled..
    One of the reasons I get so angry when I get screwed by evil people..

    • I can’t stand what our govt. has done to veterans, and to the developmentally disabled. The people who through no fault of their own (and in the case of vets, thru valor and patriotism)most need and deserve our help–and for promises to be kept!–have to go thru the most struggle to get it. Hypocrites Left and Right allow this to happen–dollars robbed from the dev. disabled to give to charity care for illegals, courtesy of the Dems–and Americans sent to fight for the monetary interests of others and to see all things veteran be defunded. And now Mrs. Obama is proclaiming love for the veterans, and I still hear horror stories like yours and that of others on a southern NJ radio program called Veterans Matter.

      We all need, I think, to climb out of our partisan ruts, realize the truth never lies fully on one side or other, rub the fairy dust out of our eyes, open the window and yell, “We’re not gonna take it anymore,” then get downstairs and flipping the bird to the band of criminals at the Capitol and in the White House.

      I’ve realized that we have to work together to solve our problems and right the wrongs perpetrated on fellow citizens by our elected and selected criminals, until we can clean them out and vote good people in. Let’s look around to see who’s already taking the initiative and help them! /off soapbox

      My deepest thanks and respect to those who sacrificed so much for a republic that we can’t ever allowed to be destroyed by evil, self-serving people. At the very least, we citizens would do well to vow never to fall asleep at the wheel again.

Thank you…. it would seem that others may hurt and a little money helps… and I might sound selfish, but believe many others that suffer would give up and kill themselves instead of waiting for better times.. that is how bad things get… and others think that sounds crazy, then you have been lucky and have not been through the misery that puts one over the edge.. just little events, that add up,, more and more times of getting screwed and being sick.. you just get so sick and tired of people screwing you… they don’t think things through or don’t care and expect people to go away so they can be greedy..

    • Steven: I do understand how you feel. I’m the sole caretaker of my 46-yr-old brother who has Down syndrome (very low IQ) and physical problems. I’m only a freelance editor who can’t work enough because of the bureaucratic BS I have to deal with weekly. I’m long divorced, no resources, mother left house to my evil twin brother, and neither bleeding heart libs nor compassionate conservatives (my butt) care. Veterans and older siblings caring for a disabled sibling: the two groups that need our help and care. Try to hang in there, if only because karma is real and you might have to relive this crap in a lifetime down the line. Might as well let this one play out and be done with it.

  120. update, I got a generic letter from the *laywers…** saying that we have to wait a few months to see if any appeals might be filed..

    everyone else will get the B.S. too! just more lies and corruption.. how can they get away with paying a few of us and telling the rest of us to go f ourselves?

  121. I live in Tennessee, I actually got a check today. It was $209.75. I thanked the Lord and deposited it using my smart phone. Good Luck to others.

  122. I too received my settlement check in the exact same amount as Niecee. $209.75. It was $209.75 I did not have before and was a very pleasant mailbox surprise amongst the bills. Mine came the 21st as well. No complaints here. Our information is bought and sold everyday. Transunion was caught and they still control whether we can buy something as simple as an economy car at a decent rate or a home to live in.

  124. Got an email that stated that TransUnion is cutting checks and will be mailed shortly after and the process should take 60 days and if I have not received it by November 17, 2012.

  126. got my $209.75 yesterday,, now I can pay my utilities which had my electricity bill jacked up because for using my small air conditioning unit to help cool me in high heat while I die from pancreas disease..

  128. I received a check yesterday, also for $209.75 from Watts, Guerra & Graft, but it doesn’t even look like a real check (i.e. no bank name/location). Has anyone else tried to cash their check yet, or even deposit it into their bank account? If so, what was the outcome?

    Two falsified credit filings against me. Freezes my credit. Causes all transactions to fail. Causes credit checks to destroy me personal and business relationships.

    Contact those involved multiple times.

    • I received a check sometime this week and was shocked. Don’t know nothing about the suit. The check was for $25.80. Others received $200-$400. How did we get screwed in a situation? Do we get more than one check? If not, I was shocked and i will be glad to take unexpected money.

  133. I HAVE BEEN A MEMBER SINCE DAY 1. NEVER GOT AN EMAIL ABO8T PAYMENT. NEVER SAW A CHECK EITHER. BEEN CHECKING THE SITE FOR LAST 5 YEARS MONTHLY.
